FotoVend Privacy Policy

FotoVend ("FotoVend," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, store, disclose, and protect information when you use the FotoVend mobile application, related photo booth services, websites, and other services that link to this Privacy Policy collectively, the "Services."

By using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

Depending on how FotoVend is configured and used at a particular event or location, we may collect the following information.

Photos and Generated Images

We may collect photographs captured through the FotoVend app and images created, edited, enhanced, or generated using the Services.

Photos may include identifiable individuals, surroundings, clothing, and other visual information contained in the image.

Contact Information

When you choose to receive or share a photo, we may collect information such as:

• Email address
• Mobile telephone number

Providing this information is optional, but certain delivery features may not work without it.

Payment and Transaction Information

When you purchase a photo, print, digital product, or other service, we may collect transaction-related information, including:

• Products purchased
• Purchase amount
• Transaction date and time
• Payment status
• Transaction or receipt identifier

Payment card information is processed by our payment-processing provider. FotoVend does not intend to directly store complete payment card numbers, security codes, or other full card credentials.

Information Collected Automatically

We may automatically collect limited technical and usage information needed to operate, secure, and improve the Services, including:

• Device type and operating-system version
• App version
• Internet Protocol address
• Date and time of use
• Error, crash, and diagnostic information
• General interaction and feature-usage information

2. How We Collect Information

We collect information:

• Directly from you when you take a photo, enter contact information, make a purchase, or communicate with us
• Automatically through your device when you use the Services
• From service providers that process transactions, deliver photos, host data, or support operation of the Services
• From the business, event operator, venue, or photo booth operator providing access to FotoVend

3. How We Use Information

We may use collected information to:

• Capture, process, generate, display, print, and deliver photos
• Send photos to the email address or telephone number you provide
• Process payments and provide receipts
• Complete and maintain transaction records
• Operate, maintain, troubleshoot, and secure the Services
• Detect fraud, abuse, security incidents, and technical problems
• Respond to support requests and other communications
• Improve FotoVend's performance and functionality
• Comply with legal, accounting, tax, and regulatory obligations
• Enforce our agreements and protect our rights, users, and property

We do not use your photos or contact information for unrelated advertising without providing appropriate notice and obtaining any consent required by law.

4. Image Processing and Artificial Intelligence

Certain FotoVend features may use automated image-processing or artificial-intelligence technologies to modify, enhance, transform, or generate images.

When such a feature is used, a photo or related information may be transmitted to a technology provider acting on FotoVend's behalf. These providers may process the information only as necessary to provide the requested feature, subject to their contractual obligations and applicable law.

FotoVend will disclose the use of third-party artificial-intelligence processing and request permission when required before transmitting personal information to such a provider.

5. How We Disclose Information

FotoVend does not sell personal information.

We may disclose information in the following circumstances.

Service Providers

We may provide information to companies that perform services on our behalf, such as:

• Cloud hosting and data-storage providers
• Payment processors
• Email-delivery providers
• SMS or text-message providers
• Printing and photo-processing providers
• Artificial-intelligence or image-processing providers
• Security, diagnostics, and technical-support providers

These providers may access or process information only as reasonably necessary to perform services for FotoVend and are expected to protect it appropriately.

Event and Photo Booth Operators

When FotoVend is operated for a business, photographer, venue, or event organizer, limited information may be made available to that operator when necessary to fulfill purchases, provide customer support, manage the event, or resolve technical issues.

Legal and Safety Reasons

We may disclose information when we reasonably believe disclosure is necessary to:

• Comply with a law, regulation, court order, subpoena, or lawful government request
• Protect the rights, safety, and property of FotoVend, our users, or others
• Investigate fraud, abuse, security incidents, or violations of our agreements
• Establish, exercise, or defend legal claims

Business Transfers

Information may be transferred as part of a merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or similar business transaction. Any recipient would remain subject to applicable privacy obligations.

6. Data Storage and Security

FotoVend stores information on cloud-based servers located in the United States.

We use reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. These safeguards may include encrypted network transmission, access restrictions, authentication controls, logging, and limited employee access.

No electronic transmission or storage system is completely secure. We therefore cannot guarantee absolute security.

7. Data Retention

We retain personal information only for as long as reasonably necessary to:

• Provide the requested photo or service
• Complete and document transactions
• Provide support
• Maintain security and prevent fraud
• Meet legal, tax, accounting, and contractual requirements
• Resolve disputes and enforce agreements

Photos and generated images are generally retained for 30 days after the event, unless a longer period is requested by the event operator, required to fulfill a service, or required by law.

Email addresses and telephone numbers used solely for photo delivery are generally retained for 30 days.

Transaction records may be retained for a longer period when required for accounting, tax, fraud-prevention, or legal purposes.

We may retain deidentified or aggregated information that can no longer reasonably identify an individual.

8. Your Privacy Choices and Rights

Depending on where you live, you may have the right to:

• Request access to personal information we maintain about you
• Request correction of inaccurate information
• Request deletion of your information
• Object to or restrict certain processing
• Withdraw consent when processing is based on consent
• Request a portable copy of certain information
• Appeal a decision concerning a privacy request
• Opt out of certain disclosures, targeted advertising, or sales of personal information

FotoVend does not sell personal information or use personal information for cross-context behavioral advertising.

To submit a privacy request, contact us using the information in the "Contact Us" section below. We may need to verify your identity before completing a request.

You may also request deletion of a photo or generated image by providing enough information for us to locate it, such as the event, approximate date and time, transaction identifier, email address, or telephone number used for delivery.

We will not unlawfully discriminate against you for exercising applicable privacy rights.

9. Camera, Photo Library, and Device Permissions

FotoVend may request permission to access features on your device, including:

• Camera
• Photo library
• Bluetooth
• Local network
• Notifications

The permissions requested depend on the features you use. You can review or revoke permissions through your device settings. Revoking a permission may prevent certain features from working.

10. Children's Privacy

FotoVend is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without legally valid authorization or verifiable parental consent.

Because FotoVend may be used at family events and may capture images containing children, a parent, guardian, or authorized event operator should supervise its use by children.

If you believe that we have collected personal information from a child in a manner that does not comply with applicable law, contact us promptly. We will review the request and delete the information when required.

Event operators are responsible for obtaining any notices, permissions, releases, or parental consents required for their particular event and use of FotoVend.

11. Third-Party Services and Links

The Services may interact with third-party payment, messaging, hosting, printing, or image-processing services. Those companies may process information under their own privacy policies as well as their agreements with FotoVend.

FotoVend is not responsible for the privacy practices of independently operated third-party websites or services.

12. International Data Transfers

If you use FotoVend outside the country where our servers or service providers are located, your information may be transferred to and processed in another country. Privacy laws in that country may differ from those in your location.

Where required, we use appropriate legal mechanisms and safeguards for international data transfers.

13. Do Not Track and Tracking Technologies

FotoVend does not currently respond to browser "Do Not Track" signals.

We do not track users across applications or websites owned by other companies for targeted advertising unless we provide the required disclosure and obtain any permission required by Apple or applicable law.

14. Changes to This Privacy Policy

We may revise this Privacy Policy periodically to reflect changes in our practices, technology, Services, or legal obligations.

When we make changes, we will update the effective date at the top of this policy. When required, we will provide additional notice through the app, our website, or another appropriate method.

Your continued use of the Services after an updated policy becomes effective signifies your acknowledgment of the revised policy.
